New regulations will make it easier to establish disability under ADA
The U.S. Equal Employment Opportunity Commission (EEOC) voted on June 18 to revise its regulations to conform to changes made by the ADA Amendments Act of 2008. The ADA Amendments Act, which went into effect January 1, 2009, makes changes to the definition of the term "disability" by rejecting the holdings in several Supreme Court decisions and portions of EEOC's prior ADA regulations. The EEOC, in its press release, stated that these regulations "will serve to shift the focus of the courts from further narrowing the definition of disability and putting it back to where Congress intended when the ADA was enacted in 1990." These new regulation will now make it easier for an individual seeking protection under the ADA to establish that he or she has a disability.
