Judge orders status conference in response to OLRS' correspondence for assistance in resolving an impasse

Judge Sargus of the U.S. District Court for the Southern District of Ohio has ordered a status conference in response to a request for assistance from OLRS in resolving an impasse related to the Martin consent order and potential relief for those class members who are involved in the case of D.M. v. Butler County Board of Mental Retardation and Developmental Disabilities (BCBMRDD).

OLRS, in its correspondence to the court, explained the impasse and asked the Court what remedy might be available in the Martin consent order for 13 Butler County residents. The 13 residents, members of a class represented by OLRS in D.M. v. Butler County Board of Mental Retardation and Developmental Disabilities, are seeking community placements from the BCBMRDD. OLRS has alleged that the Board did not take full advantage of the opportunities for Martin class members in their county and has not placed them in the least restrictive environment appropriate to meet their needs.

The status conference is scheduled for May 21, 2009 at 10:00 a.m. in the judge's chamber.
