OLRS comments on Medicaid Schools Program proposed rules revisions; Advocates to safeguard the rights of students with disabilities
The Ohio Legal Rights Service (OLRS) submitted comments to the Ohio Department of Education on proposed revisions to rules implementing the Medicaid Schools Program (MSP). OLRS strongly recommended that students and families give consent, in addition to being notified, when a local education agency (LEA) wants to access their Medicaid benefits as required under state and federal law for both the MSP program and the Individuals with Disabilities Education Act (IDEA). OLRS also recommended that MSP include access to all federally allowable Medicaid reimbursement across all disability categories.
The MSP authorizes LEAs that choose to become Medicaid providers to receive reimbursement for medically necessary services provided to students who are eligible under both Medicaid and the IDEA.
